These Terms of Service ("Terms") govern your use of Caplyr's services, including the website at caplyr.com and the Caplyr SDK (collectively, the "Service").

Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Description of Service

Caplyr provides AI cost management tools including budget guardrails, automatic model downgrading, and kill switch functionality for AI API calls. Caplyr acts as a middleware layer between your application and AI providers. Caplyr does not process, store, or have access to the content of your AI prompts or responses.

Your Responsibilities

You are responsible for: maintaining the security of your API keys and account credentials, all activity that occurs under your account, ensuring your use of the Service complies with applicable laws, and maintaining your own agreements with AI providers (Anthropic, OpenAI, etc.).

Billing and Payment

Paid plans are billed monthly through Stripe. You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. The free tier is available indefinitely with no payment required.

Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Caplyr SDK is designed to fail safe — if our backend is unreachable, your AI API calls will continue using last-known configuration. We are not liable for costs incurred with your AI providers, whether or not our Service is functioning correctly.

Limitation of Liability

Caplyr is provided "as is" without warranty of any kind. In no event shall Caplyr be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
